Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1280

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The Court of Appeal may adopt an approach to assessing maintenance different from that of the court of first instance. Its response to that court's evidence. Not necessary. It suffices that its view have an established basis in the papers and be justified. - Granting the parties' request to conduct an evidentiary investigation in the action to establish particular facts: is not a right of theirs. The court may disregard it whenever it finds sufficient material in the papers to form its conviction. Example concerning the Court of Appeal's increase of the spousal maintenance imposed by the judgment of the court of first instance and its refusal of the request to refer the appeal for an evidentiary investigation to establish the validity of the appellant's defence.
