Kuwait Court of Cassation principle number 225

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The supremacy of national law. Its necessary consequence is abstention from applying any foreign legislation. The judge must resort to interpreting national legislation if it is obscure to him, using the various legal methods of interpretation, including reference to its location in foreign legislation if that legislation was its source. It is impermissible to depart from this by applying another special rule contained in that legislation which the national legislature did not wish to adopt among its provisions.
