Kuwait Court of Cassation principle number 506

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A disposition by a debtor subject to Law No. 41 of 1993 concerning the State's Purchase of Certain Debts in favor of a relative up to the second degree. It is ineffective against the State if it did not have an authenticated date before 2/8/1990. Article 12 of the said Law. - The appellant, who is subject to Law 41 of 1993, selling his undivided share in a property to his son after 2/8/1990. Its ineffectiveness against the State. His reliance on Article 216/h of the Code of Procedure does not alter this. The basis thereof: the provisions of the general law may be applied only to matters not regulated by the special law, and the consequence of the appellant and his wife selling the property is that they no longer needed it as a dwelling, so the prohibition of attachment prescribed in that Article does not apply to it.
