State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The absence, in the provisions of Law 38/1964 concerning labor in the private sector, as amended, of a provision governing the application of interest to financial obligations arising from an employment contract and owed by one party to the other. Its implication and necessary consequence: recourse in this regard to the provisions of the Civil Code prohibiting claims for interest, rather than the provisions of the Commercial Law permitting the collection of such interest. The reason therefor.
