Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 596

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Excluding the applicable provisions of foreign law. Impermissible unless they contravene public policy or morals in Kuwait, affect the entity of the State, or concern a public and fundamental interest of the community. An example of what does not fall within the scope of contravening public policy or morals: the difference between the Jordanian compulsory insurance system, in its provisions identifying which passengers of the vehicle causing the accident are excluded from third parties and are not covered by compulsory insurance, and the provisions of Kuwaiti law.
Arabic original
