Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 900

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Decisions transferring civil servants. They fall outside the Administrative Circuit’s jurisdiction so long as they do not embody a decision concerning a matter within that Circuit’s jurisdiction. The reason therefor. The administration has discretionary authority to transfer an employee and make use of him at the location it wishes, and the judiciary has no jurisdiction over this decision so long as the procedures do not reveal that the administration intended, through this transfer, to punish the employee without following the prescribed procedures and formalities. - 533 - Civil Procedure
