Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 913

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The Administrative Circuit's ruling that it lacks jurisdiction to hear the dispute on the ground that the appellant is a member of the police force affiliated with the Ministry of Interior and that its jurisdiction is confined to disputes concerning civil servants, without stating expressly or implicitly, whether in its reasons or its operative part, that the other circuits of the Court of First Instance lack jurisdiction to hear it. Its failure to couple its ruling with a referral. This does not constitute a ruling that any of those circuits lacks jurisdiction to hear it.
