Kuwait Court of Cassation principle number 966
State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
Disputes relating to a gift contract after the Civil Code came into force. The Civil Circuits have jurisdiction over them, to the exclusion of the Personal Status Circuits. Departure from this. An error in the application of the law. Violation of the rules of jurisdiction. It does not vitiate the judgment with nullity but with violation of the law. - Res judicata effect. Its provisional attachment to conclusive judgments even if they are subject to challenge. Suspension of that effect upon their appeal and until the appeal is determined, whereupon it returns upon their affirmation and ceases upon their reversal. The consequence thereof. No court is bound by this effect so long as dismissal of the appeal has not been adjudged before it delivers its judgment in the action. - 549 - Civil Procedure
