Kuwait Court of Cassation principle number 1
State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
Interest is the criterion for a plea, just as it is the criterion for an action. - A plea that an action is inadmissible because it was brought by a person lacking legal capacity. It is inadmissible whenever the defect affecting those of diminished capacity has ceased to exist. Removal of the defect validates the litigation procedures from their inception. Example.
Arabic original
Original Arabic judgment citations
