Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1193

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The basic principle of the litigation system is that it operates at two levels, so new claims are not admissible on appeal. - The judgment's limiting its requests before the first instance to a request for the appointment of an expert in preparation for seeking an award of what his report discloses. Its effect. The scope of the action is thereby defined, without extending to the assertion that an award of what the expert's work discloses was actually sought. The necessary consequence is that a request for an order imposing an obligation before the Court of Appeal is a new, inadmissible claim.
