Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1486

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Referral of an action from one court to another on grounds of connection does not require identity of subject matter, cause, or parties. It is sufficient that a connection exists between the two actions such that determination of one affects the manner of judgment in the other. Assessment of this connection falls within the authority of the court of merits, provided it is reasonable.
