The death of either party to the proceedings after the action has become ready for judgment on its merits does not prevent judgment therein. The basis thereof. Article 94 of the Civil Procedure Law. - When an action is considered ready for judgment before the Court of Cassation. - Completion of procedures before the Court of Cassation by the respondent's filing of a memorandum of his defence within the time limit; the subsequent death of the appellant has no effect on its hearing.
