Lapse of proceedings does not concern public policy but relates to the litigant's interest. The implication thereof. He may waive it expressly or implicitly. The right to invoke it is forfeited by addressing the merits. - Appellate proceedings, for purposes of applying lapse, are independent of and distinct from proceedings at first instance. The rules of lapse applicable to either have no effect on the other.

سقوط الخصومة لا يتعلق بالنظام العام وإنما يتصل بمصلحة الخصم مؤدى ذلك. جواز تنازله عنه صراحة أو ضمناً. سقوط الحق في التمسك به بالتكلم في الموضوع. - خصومة الاستئناف في مجال تطبيق السقوط مستقلة عن الخصومة أمام أول درجة ومتميزة عنها. ما يجري على أحدهما من أحكام السقوط لا أثر له على الأخرى.Original Arabic judgment citations
