Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1745

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Deeming an action never to have been brought if the defendant is not summoned to appear within ninety days from the date its statement is submitted to the Registry. Its condition is that the delay in service be attributable to the claimant's act, whether intentional or negligent. - The prescribed time limit for service of the statement of appeal on the respondent, failure to observe which permits a ruling deeming the appeal never to have been brought. A time limit for appearance. The respondent's appearance after its expiry does not cure it, nor does it extinguish his right to request a ruling deeming the appeal never to have been brought.
