Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1758

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The plea that an action be deemed as never having been brought because more than ninety days have elapsed since it was struck out concerns the interest of the litigant for whose benefit it was established. Its implication is that he may waive it. The effect thereof: he may not thereafter retract that in respect of which he relinquished his right.
