Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1780

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Deeming an action never to have existed because the prescribed period for resuming proceedings has expired. The court must so rule whenever requested, whatever the reason for failing to resume proceedings in the action, without the court having any discretion. The sanction is prescribed in the defendant’s interest and does not concern public order.
