Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1814

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An interest is a condition for the permissibility of an appeal. Example. A request to appoint an expert before the court of first instance and its granting of that request. A ruling that the action has ended and its affirmation, on its reasons, by the challenged judgment. The appellant has no interest in challenging it by cassation. This is not affected by the judgment’s superfluous elaboration, exceeding the scope of the action and having no binding authority, that it endorses the expert’s report.
