Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1824

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judgment that acquires res judicata effect. Its condition. It must be conclusive by putting an end to the dispute in the action in its entirety, or in part thereof, or in an issue arising therefrom, and the court thereby exhausts its adjudicative authority in what it addressed. - Non-conclusive judgments, including evidentiary judgments, have no res judicata effect and do not bind the court when hearing the action. When these judgments acquire res judicata effect and terminate the court's adjudicative authority.
