Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1969

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Advertising public positions does not create a legal status therein for applicants. The reason for this. Such status arises only by an appointment decision, and refraining from making it is not considered a negative administrative decision, given the administration's discretionary power to issue it and to choose the time for filling vacant positions. Its implication. The procedures preceding appointment do not bind the authority competent to appoint, which may abandon them, and the position remains vacant even if the applicant satisfies the conditions for appointment to it.
