Sale of undivided shares in land for which no subdivision decision has been issued. Its condition. Obtaining prior permission from Kuwait Municipality in accordance with the controls and conditions issued by a decision of the Municipal Council. Contravention thereof. Its effect. Nullity of the contract. Interested parties may invoke it, and the court may rule on it of its own motion. Article 1 of Decree-Law 92 of 1976. - Decree-Law 92 of 1976 concerning Certain Provisions Relating to Dispositions of Real Estate. The legislature's objective therein. - A contract of sale concerning an undivided share in a plot for which no subdivision decision has been issued. Void. It may not be relied upon in an action for partition and allotment. - 432 - Civil Procedure

بيع الحصص الشائعة في أرض لم يصدر بها قرار تقسيم. شرطه. الحصول على إذن مسبق من بلدية الكويت وفقاً للضوابط والشروط التي تصدر بقرار من المجلس البلدي. مخالفة ذلك. أثره. بطلان العقد. جواز التمسك به من ذوي الشأن وللمحكمة أن تقضي به من تلقاء نفسها. المادة الأولى من المرسوم بق ٩٢ لسنة ١٩٧٦. - المرسوم بالقانون ٩٢ لسنة ١٩٧٦ ببعض الأحكام الخاصة بالتصرف في العقارات. هدف المشرع منه. - عقد البيع الذي ينصب على حصة شائعة من قسيمة لم يصدر قرار بتقسيمها. باطل. عدم جواز الاستناد إليه في دعوي الفرز والتجنيب. - ٤٣٢ - المرافعاتOriginal Arabic judgment citations
