Kuwaiti courts. Their jurisdiction. Hearing actions brought against a Kuwaiti, whether relating to personal status or property matters, whether civil or commercial, whether or not he has a domicile or residence in Kuwait, and whether the claimant is a Kuwaiti or a foreigner domiciled in Kuwait, residing therein, or present outside it. Likewise, actions brought against a foreigner who has a domicile or residence in Kuwait. Exception. Immovable-property actions relating to property outside Kuwait, whether personal immovable-property actions, actions in rem concerning immovable property, or mixed actions, but not personal movable-property actions even if connected with immovable property situated abroad. Purpose thereof. Narrowing the scope of actions exceptionally excluded from the international jurisdiction of Kuwaiti courts. Immovable property is one of the fundamental manifestations of state sovereignty, and enforcement of judgments relating to it takes place in the state where it is situated, which will not permit their enforcement if issued by foreign courts.
