Kuwait Court of Cassation principle number 2445
State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The general planning boundary. All land outside it is deemed State property. Land within the plan. Considered to fall within the bounds of individuals' private ownership, except what is established to belong to the State by one of the legally prescribed methods. Individuals and private entities may claim ownership thereof and adduce evidence thereof without being bound by Law No. 5 of 1975, which aimed to protect State property within the planning boundary. The rationale: that Law contains nothing indicating that land within the planning boundary belongs to the State. Its effect. A claim to ownership of land therein is not subject to the procedures prescribed in Article 1 of Law 33 of 2000 concerning claims to ownership of State real estate. - A real-property action relating to property outside Kuwait:-
