An action to prevent interference with possession. The judge may examine documents relating to the underlying right for guidance and to the extent required to ascertain the absence or existence of interference. Permissibility of appointing an expert to identify the property subject to interference. The judgment rendered therein does not acquire res judicata effect as regards the underlying right.

دعوى منع التعرض . للقاضى فحص المستندات المتعلقة بأصل الحق على سبيل الاستئناس وبالقدر الذي يقتضيه التحقق من نفى أو إثبات التعرض . جواز ندب خبير للتعرف على العقار موضوع التعرض . الحكم الصادر فيها لا يجوز حجية بالنسبة لأصل الحق .Original Arabic judgment citations
