Service of the originating pleading. A condition for constitution of the proceedings. Contravention thereof. Its effect. The proceedings cease to exist and the judgment is void, and the court may so rule of its own motion. Its ruling that the appealed judgment is void owing to invalid service of the originating pleading. Its necessary consequence. It must confine itself to ruling on nullity without determining the merits. An example.
