Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3053

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judgment deeming the appeal as never having been brought at the respondent’s request. The prerequisite for such a ruling. Failure to summon him to appear within the legally specified period owing to an act attributable to the appellant. Discretionary for the court and left to its assessment. Its conclusion not to impose this sanction. Criticizing it for not exercising that power. Without foundation.
