Nullity of service of statements of claim and summonses to appear. Relative nullity unrelated to public policy. It is cured by the addressee's appearance at the hearing specified in the notice or by filing a memorandum of defence. The reason for this: fulfilment of the purpose of the procedure. - In determining the validity of a procedure, regard is had to its intended purpose without stopping at the form prescribed by law.

بطلان إعلان صحف الدعاوى وأوراق التكليف بالحضور. بطلان نسبي لا يتعلق بالنظام العام. زواله بحضور المعلن إليه في الجلسة المحددة في الإعلان أو إيداع مذكرة بدفاعه. علة ذلك: تحقق الغاية من الإجراء. - الاعتداد في صحة الإجراء بالغاية المرجوة منه دون الوقوف عند حد الشكل الذي رسمه القانون.Original Arabic judgment citations
