Inference of the existence of capacity in the action. A matter of fact. Independently determined by the judge of merits. - Inclusion of a statement of the capacity of the person bringing the action in a particular place in its statement of claim. Not legally required. Its inclusion anywhere therein in a manner indicating that capacity is sufficient.
