Kuwait Court of Cassation principle number 3664
State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
Recourse to the court that rendered the judgment for its interpretation. Its prerequisite: ambiguity or obscurity in the operative part of the judgment. Its clarity. Does not permit recourse to that court. The reason: so that interpretation does not become a pretext for reversing the judgment and impairing its binding authority. - The court’s authority upon a request to interpret a judgment stops at ascertaining its clarity, without extending to its resulting effects. Example concerning a request to interpret a judgment invalidating the sale of a newspaper and its printing press. 38- Its authority to consider the action ready for determination:-
