Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3704

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Prohibiting the debtor from traveling. Its condition is that the debt be certain in existence and due for payment, and that serious reasons exist to suspect that the debtor will flee the debt despite being able to pay. Assessment thereof falls within the authority of the trial court. Merely disputing the right does not negate its existence.
