Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4038

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A final judgment is one that resolves the dispute between the parties and prevents a return to the same dispute through a subsequent action. Contravention thereof renders it defective for infringement of the right of defense and inadequate reasoning and necessitates its cassation.
