Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4064

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The contract of carriage places upon the carrier the obligation to deliver the goods intact and complete, in the described condition in which they were handed over to him, at the port of arrival. If damage befalls them, the carrier is obliged to compensate for it unless evidence negating this liability is produced. No fault attaches to the court of merits if it refuses to appoint an expert to assess compensation. Example.
