Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4469

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An action for liability for an unlawful act is time-barred upon the lapse of three years from the day the injured person learned of the damage and the person responsible for it, or fifteen years from the date the unlawful act occurred, whichever period expires first. The knowledge from which the short limitation period begins. Its intended meaning. The burden of proving knowledge in its legally intended sense rests on the party invoking the time bar. Inferring or negating such knowledge is among the factual matters independently determined by the court of merits, provided that it bases its inference on sound reasons. An example of a sound response rejecting a plea that the action is barred by the three-year limitation period.
