An action for the validity and enforceability of a sale contract. Its purpose. Specific performance of the seller’s obligations and obtaining a judgment whose registration takes the place of the contract in transferring ownership. Its effect. Transfer of ownership to the purchaser and registration of the judgment rendered therein must both be possible. Contravention thereof. An error requiring cassation of the judgment. Example of the sale of real property that has been expropriated.

دعوى صحة ونفاذ عقد البيع. المقصود بها. تنفيذ التزامات البائع تنفيذاً عينياً والحصول على حكم يقوم تسجيله مقام العقد في نقل الملكية. أثره. وجوب أن يكون انتقال الملكية إلى المشترى وتسجيل الحكم الذي يصدر فيها ممكنين. مخالفة ذلك. خطأ يُوجب تمييز الحكم. مثال لبيع عقار نزعت ملكيته.Original Arabic judgment citations
