The broker's remuneration. Is payable by the contracting party who commissioned him to complete the transaction, not the other party. Ruling that the conclusion of the transaction as a result of the broker's efforts commissioned by one of the two parties suffices to entitle him to remuneration from the other, without investigating the latter's defense that there was no need for the broker's efforts and that his field of work differed. Error in applying the law and inadequacy of reasoning.

أجر السمسار. وجوبه على المتعاقد الذي كلفه إتمام الصفقة دون الآخر. القضاء بأن إبرام الصفقة نتيجة سعي السمسار بتكليف أحد الطريفين كاف لاستحقاق الأجر من الآخر دون تحقيق دفاع هذا الأخير بعدم الحاجة لمجهود السمسار ولاختلاف مجال عمله. خطأ في تطبيق القانون وقصور.Original Arabic judgment citations
