Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1226

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The judgment must resolve every dispute concerning any element of the case upon which its determination depends. Its refusal to examine a comprehensive accounting between the parties necessary to resolve the dispute in its entirety, stopping at the statement that the amount paid exceeds the value of the instruments on some of which the action was founded, and allocating payment to the debt, thereby preventing it from examining the facts of the case and addressing the defence therein. Invalidating inadequacy of reasoning.
