State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The plea raised by the appellant's representative that paragraph 1 of Article 1 of Law 18 of 1969 concerning the demarcation of State property outside the general planning boundary is unconstitutional. Failure of the lawyer filing the appeal to submit a power of attorney authorizing him to raise the plea. Its effect. Its inadmissibility because it was raised by a person lacking capacity. This is not altered by his authorization to lodge an appeal or cassation appeal, or by inclusion in the power of attorney of authorization to take the formal legal procedures required by actions. The reason therefor.
