English translation of the principle

Judgments rendered in certain personal status matters. Their res judicata effect is temporary. The reason for this. Their susceptibility to amendment and change. - Res judicata precluding renewed litigation of a fundamental issue. Its criterion. The parties having contested it in the first action and its truth having been settled between them by the first judgment. The implication. That adjudication acquires res judicata effect. Its effect. Preclusion of disputing it by way of an action or defence concerning any subsidiary right whose establishment depends on that fundamental issue previously decided. A difference in the relief sought in the 2 actions does not alter this, so long as their basis is the same. Article 53, Law 39/1980. Example.
