Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1870

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The Court of First Instance's final-instance monetary threshold of five thousand dinars covers all disputes that the said court has jurisdiction to determine at first instance. - The rule is that judgments rendered by the court of first instance as final judgments may not be appealed. Exception. - The appellant's specification of his claims before the first instance as a declaration that he is free of the maintenance debt adjudged against him and an order requiring - 300 - Civil Procedure the respondent to repay 2920 K.D. is in reality a single claim for repayment of that amount, on the basis of which the value of the action is assessed, and the judgment rendered may not be appealed because the monetary threshold is not met. The challenged judgment's departure from this view and its implied ruling that the appeal is permissible. Renders it defective.
