Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1875

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments rendered during the course of an action, whatever their type, may not be challenged separately before the final judgment terminating the litigation therein is rendered. The exception. Example: a judgment recording abandonment of the proceedings against a litigant, setting aside the first-instance judgment, and remitting the action to the court of first instance for determination is a judgment that does not terminate the litigation and is not among the exceptions; it therefore may not be challenged. - 301 - Civil Procedure
