Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1880

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments rendered during the course of proceedings before the final judgment terminating them. They may not be challenged independently. Exception. Provisional and urgent judgments, judgments staying the action, and judgments deciding part of the merits and capable of compulsory enforcement. Reason for this. Preventing the fragmentation of a single case and its distribution among several courts, and the resulting delay in determining the merits of the action and increase in litigation expenses. Example. - A judgment declining subject-matter jurisdiction and referring the action does not terminate the proceedings and does not fall within the exceptions.
