State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An arbitrator's award. The rule is that it may not be appealed. Exception. Challenging it by an original action for nullity in certain cases exhaustively specified by the legislature. What those cases are. Those cases may not be used as a means to impugn the award on the same grounds of objection that constitute grounds for appealing judgments. Reason for this. - An award of the Arbitration Committee of the Kuwait Stock Exchange. Final and binding on both parties to the dispute. Bringing an action challenging it on grounds that do not fall within one of the cases permitting an action for nullity by way of exception. Impermissible. The challenged judgment reaching that conclusion. No defect.
