Kuwait Court of Cassation principle number 1932

An appeal against the judgment rendered in the principal action. Does not, in itself, bring the ancillary indemnity action before the appellate court. Exception. Where the party seeking indemnity was precluded from appealing the judgment rendered in his action because the judgment granted all his claims in the principal action. Its effect. An appeal against the judgment in the latter action. His action may be brought before the Court of Appeal by joining his adversary and directing the claim against him, unless he is already a party.
