Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2253

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Recourse to the court that rendered the judgment for its interpretation. Criterion: obscurity or ambiguity in the operative part of the judgment. Its clarity. Does not permit recourse to that court. Reason: so that interpretation does not become a pretext for retracting the judgment and impairing its res judicata effect. - The court's power in an application for interpretation of a judgment stops at ascertaining its clarity, without extending to its ensuing effects. Example concerning an application to interpret a judgment declaring the sale of a newspaper and its printing press void.
