Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2383

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Determining the part of the court of first instance’s judgment challenged on appeal. Its criterion: the appellant’s claims set out in the appeal petition, not the grounds relied upon. A request to set aside the appealed judgment. This requires the Court of Appeal to reconsider the underlying dispute in all its aspects without being bound by the view of the court of first instance.
