Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2498

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The period for challenging a judgment begins, as a rule, on the date it is rendered, and begins on the date it is served in cases where the party against whom judgment was rendered failed to appear at all hearings and did not submit a memorandum of defense, and in judgments in which that party is presumed unaware of the proceedings and their procedures. - Where the period for challenge begins on the date the judgment is rendered, the date stated in the original judgment, rather than the served copy, is controlling. The reason therefor.
