Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2549

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Grounds of appeal. Their purpose is to ensure the seriousness of the challenge, not to define its scope. It suffices to state them briefly or to include some of them in the petition, and the appellant may add to them without being bound by the time limit for appeal or its service, or abandon some of them, and the Court of Appeal may rely on others, unlike a cassation appeal, which is considered only through the grounds detailed in its petition and no others, unless they concern public policy. - Ruling that the appeal is null for failure to clarify its grounds in its petition and disregarding the contents of the appellant’s memorandum submitted after expiry of the time limit for service of the petition. A violation of the law.
