Invalidity of service of the notice of appeal and the failure of the person served to appear before the Court of Appeal. Its effect. The latter’s right to invoke this invalidity for the first time before the Court of Cassation and to make it a ground for seeking cassation of the judgment, without this being considered reliance on a new ground.
