Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2673

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments rendered by the court of first instance in a final capacity. The rule is that they may not be appealed. Exception. Deficiency in the judgment’s factual grounds entails its nullity. Deficiency in its legal grounds, however, does not render it void but makes it tainted by an error in applying the law.
