Agency terminates upon the death of the principal or agent or the loss of capacity of either. - The principal may at any time dismiss his agent or restrict his agency even if an agreement to the contrary exists. - The agent may withdraw from his agency even if an agreement to the contrary exists. - Legal transactions undertaken by the agent before his death remain in existence, producing all their effects in accordance with the rules of agency. - The heirs, if they have capacity and are aware of the agency, must promptly notify the agent of their predecessor's death and take such measures as the circumstances require in the principal's interest. These measures do not mean that they replace the agent in his agency but are intended to preserve the principal's interests. - Termination of agency upon the death of either party is not a matter of public policy.
