Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2780

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An appeal transfers the action in the state it was in before the appealed judgment was rendered, solely as regards the matters appealed. The Court of Appeal examines the same dispute anew. It does not examine a new case whose subject is the correctness or error of the first-instance judgment.
